• We will critically review the decision of the Local Planning Authority.
• We will offer sound, objective advice on whether an appeal has a realistic prospect of succeeding or whether the correct course of action is to amend the original proposal to address the reasons for refusing the development.
Understanding the Appeal Process
We will identify the key planning issues that need to be considered at appeal and advise on the evidence which will need to be gathered to support the appeal, which could involve input from expert consultants from other disciplines.
Our Chartered Town Planner will advise which would be the most appropriate procedure to have your case heard. Our Planning Team understand the procedural complexity of lodging an appeal and performing within the strict timetable dictated by the Planning Inspectorate.
We will attend to all aspects of the appeal from lodging the evidence, preparing rebuttal
statements, provide advice on whether to submit a cost application against the Council and be present at any Inspector site visits.
The Appeal Decision
If allowed, we will explain how the conditions of the decision need to be met.
We will carefully analyse an unfavourable decision. We will advise whether the Inspector’s
reasoning is legally valid, challengeable in the High Court or alternatively, whether a revised
proposal would address the concerns raised.
