Planning Appeal Win at Historic Property

Salmon Planning wins appeal for the conversion of a grain barn into five dwellings under Class Q of the Town and Country Planning (General Permitted Development) Order 2015. Located within the setting of a historically important Grade II* Listed House and Grade II Registered Park and Garden, we are delighted with this success achieved in June 2024.

This Appeal was based on whether the proposal would have a harmful impact on a Grade II* Listed Building and Grade II Registered Park and Garden of significant historic importance.


The case is of particular interest since the Grade II* Listed house was built as the country  house for William Pitt, the Elder (British Prime Minister 1766-1768). In  addition, the parkland in which the grain barn is located was altered in the 20th century by renowned landscape architect Harold Peto.  There is also a Grade 1 Listed monument in the grounds designed by Capability Brown.


This is a noteworthy case as the Local Planning Authority conceded on two of the three  reasons they had initially refused the application on. The third reason cited concern about the  harmful impact of the conversion on designated heritage assets. 


Despite the significant heritage value and historic interest of the site, the Inspector’s view was that the proposed conversion of a large-scale, late 20th Century grain barn, and the  removal of grain drying equipment would have a benign effect on the significance of this  highly valued Listed Building and Registered Park and Garden, and therefore there was no  reason to prevent prior approval. 


Having won the Appeal to build five dwellings under the transitional provisions of the Order,  a second Class Q application has now been made to the Local Planning Authority for the  conversion of the grain barn into eight dwellings. This application takes advantage of the  May 2024 amendments to the Order. 


This is one of many cases where Salmon Planning have challenged a Local Planning  Authority decision and succeeded in winning the argument at Appeal. This case is significant as it has unlocked a development site in a beautiful historic landscape location where development would not normally be permitted.
